Do I Qualify for Divorce in Illinois? 

You may file for divorce at the circuit court where you and your spouse live. To qualify, you must be a resident of Illinois for at least 90 days. You may use state-wide forms to file for divorce and county-specific options. There may be county-specific rules that apply, so ensure you check your local superior court website in addition to downloading the forms listed below.

Illinois is a no-fault state, meaning you do not need to have a reason to file beyond irreconcilable differences, and you do not need your spouse’s permission to file. There are different forms to use if you’re filing a contested divorce vs. an uncontested divorce.

  • Joint Petition for Simplified Dissolution of Marriage and Verification of Joint Petition for Simplified Dissolution of Marriage,
  • Application for Waiver of Court Fees,
  • Judgment for Dissolution of Marriage,
  • Agreement as to Assets and Debts, and 
  • Joint Affidavit Regarding Separation of the Parties Division of Property and Waiver of Bifurcated Hearing and Verification of Joint Affidavit Regarding Separation of the Parties Division of Property and Waiver of Bifurcated Hearing. 

Most of these must be signed in front of a notary. Once completed, you will e-file your entire packet with your local circuit court. If you don’t meet these requirements, don’t worry. You can still download divorce papers in Illinois for a standard dissolution or divorce.
